In accordance with Art. 2 Para. 6 BayHSchG, Art. 4 Para. 1 S. 1 and 2 BayEGovG, we offer our services and administrative services as well as information for the public about our activities on our websites.
Our social media appearances are part of our public relations work. Our aim is to inform and exchange information with you in a target group-oriented manner, Art. 2 para. 6 BayHSchG . Wenn Sie sich an der Technischen Hochschule Deggendorf (THD) immatrikulieren, werden Ihre persönlichen Daten im weiteren Verlauf für die Studierenden- und Prüfungsverwaltung, zur Unterstützung der Bearbeitung Ihrer internationalen Angelegenheiten wie Auslandssemester, für die Studienorganisation sowie für Stipendienangelegenheiten und als Grundlage für Talentförderungen übernommen. Außerdem nutzen wir die erhobenen Daten um Systemzugänge (Netzwerk, Online-Portale, Lernplattformen, Bibliotheksnutzung, Raumnutzungen) zu organisieren.

Im Bewerbungsverfahren nutzen wir Ihre persönlichen Daten ausschließlich für den Kontakt mit Ihnen und die Abwicklung des Bewerbungsverfahrens; das umfasst auch die Einladung zu einschlägigen Infoveranstaltungen.

In der Studierenden- und Prüfungsverwaltung werden die Daten für den Kontakt mit Ihnen, für das Antragsmanagement (Beurlaubungen, Fristen, Anrechnungen etc.) sowie für die Praktikums-, Gebühren- und Prüfungsverwaltung im Rahmen der rechtlichen Vorgaben genutzt. In der Studienorganisation nutzen wir die Daten für Fächereinschreibungen, Stundenplanung etc. Im Rahmen der Stipendienangelegenheiten erfassen wir Ihre über die Hochschule abzuwickelnden Stipendienanträge (z.B. Deutschlandstipendium) und nutzen die vorhandenen Daten für die zielgerichtete Information über Stipendienprogramme, die Talentförderung und die Vergabe von Preisen an Studierende und Absolventen. In einigen externen Förderprogrammen haben die Hochschulen das Recht geeignete Studierende vorzuschlagen: Wir ermitteln in PRIMUSS die Studierenden, die die Kriterien der Förderprogramme am besten erfüllen; ein Vorschlag, in dem Ihre persönlichen Daten an externe Stipendiengeber übermittelt werden, erfolgt nur mit Ihrer Einwilligung.

Mit Ihren persönlichen Daten unterstützen wir auch Ihre Bewerbung um Plätze an ausländischen Partnerhochschulen: Eine solche Bewerbung wird im Mobility-Online-System der THD erfasst und abgewickelt. Aus PRIMUSS werden aktuelle arithmetische Prüfungsnotenschnitte für die Vergabe nach Ranglisten geliefert, sofern mehr Bewerbungen vorliegen als Plätze vorhanden sind. Bei Erstsemestern, die sich bewerben, wird mangels Prüfungsnoten die Durchschnittsnote der Hochschulzugangsberechtigung übermittelt.

Als Bewerber und wenn Sie bei uns immatrikuliert sind, erhalten Sie von uns jeweils passwortgeschützte Systemzugänge für die digitale Erledigung Ihrer Bewerbung und Ihrer Anträge und Verfahren in den PRIMUSS-Portalen für Bewerber und Studierende: Wir protokollieren Ihre Zugriffe und Aktivitäten, um jederzeit die Rechtmäßigkeit der Zugriffe nachvollziehen und die Aktivitäten nachweisen zu können. Bei Studiengängen, die am bundesweiten Zulassungsabgleich, dem sogenannten dialogorientierten Serviceverfahren (DoSV) teilnehmen, werden Ihre Bewerbungsdaten an die für das DoSV zuständige Stiftung für Hochschulzulassung (siehe www.hochschulstart.de) für den bundesweiten Bewerbungs- und Zulassungsabgleich übermittelt und mit den dort von Ihnen hinterlegten Daten abgeglichen (Rechtsgrundlage § 37 a Bayerische Hochschulzulassungsverordnung - BayHZV).

Im Rahmen der Zulassung und des Studienverlaufs erfolgt ein Abgleich Ihrer Daten mit Ihrer Krankenkasse (Rechtsgrundlage Studentenkrankenversicherungs-Meldeverordnung, SKV-MV vom 27. März 1996 in der aktuellen Fassung) sowie ggfs. eine Datenübermittlung an das Studentenwerk Niederbayern/Oberpfalz im Zusammenhang mit von Ihnen dort gestellten BAföG-Anträgen (Rechtsgrundlage §§ 47 / 48 Bundesausbildungsförderungsgesetz – BAföG).

In Studiengängen, die wir gemeinsam mit anderen Hochschulen anbieten bzw. gemeinsam Abschlüsse verleihen, übermitteln wir den Partnerhochschulen Ihre abschlussrelevanten persönlichen Daten. Diese Hochschulen sind dabei in gleicher Weise auf die Einhaltung des Datenschutzes verpflichtet.

In gebührenfinanzierten Studiengängen arbeiten wir teilweise mit Dienstleistern zusammen, die für uns diverse Aufgaben in der Organisation und Abwicklung der Studiengänge übernehmen. Für diesen Zweck stellen die THD diesen Dienstleistern die bei Ihnen erhobenen und für die Dienstleistung notwendigen persönlichen Daten zur Verfügung. Die Dienstleister werden dabei selbstverständlich in gleichem Umfang auf die Einhaltung des Datenschutzes verpflichtet wie es die THD ist.

Die Hochschule hat in vielen Stipendienprogramme ein Vorschlagsrecht für mögliche Kandidaten unter den Studierenden: Ihre Kontakt- und Leistungsdaten geben wir stets nur mit Ihrer Einwilligung weiter. Eine Datenweitergabe auch ohne Ihre Kenntnis ist zulässig auf der Grundlage des § 27 BayDSG zur Vorbereitung und Durchführung staatlicher oder kommunaler Auszeichnungen oder Ehrungen.

Die THD betreibt PRIMUSS als Prüfungs-, Immatrikulations- und Studierendenverwaltungssoftware im Verbund mit neun weiteren Hochschulen. Die Systeme einschließlich der Online-Portale werden zentral im Regionalen Rechenzentrum Erlangen-Nürnberg gehostet und vom PRIMUSS-Verbund administriert. Für den PRIMUSS-Verbund ist dessen Kompetenzzentrum zuständig: Für die zentrale Administration und den Second-Level-Support der Onlinedienste ist das PRIMUSS-Kompetenzteam der Hochschule Coburg, für den Second-Level-Support der Fachanwendungen das der Technische Hochschule Deggendorf zuständig. Ihre Pflicht zur Bereitstellung der personenbezogenen Daten / mögliche Folgen der Nichtbereitstellung (Art. 13 Abs. 2 lit e DSGVO)

Gemäß Art. 42 Absatz 4 Bayerisches Hochschulgesetz (BayHSchG) sind Sie zur Angabe aller persönlichen Daten mit Relevanz für die Abwicklung Ihrer Bewerbung und Ihres Studiums verpflichtet. Sollten Sie abgefragte, entscheidungsrelevante Daten nicht angeben, können Sie darauf beruhende Ansprüche (z.B. auf Zulassung zum Studium, Immatrikulation, Prüfung, Beurlaubung, Fristverlängerungen und Zugänge etc.) verlieren.

Geplante Speicherdauer Ihrer personenbezogenen Daten (Art. 13 Abs. 2 lit DSGVO)

Die nachfolgenden Lösch- bzw. Anonymisierungsfristen gelten vorbehaltlich der Umsetzung des Bayerischen Archivgesetztes (BayArchivG). Sofern Unterlagen archivierungswürdig sind, werden sie vor Löschung bzw. Anonymisierung zur Archivierung angeboten und ggfs. übergeben.

Ihre Bewerberdaten werden ausschließlich zur Bearbeitung Ihrer Bewerbung genutzt. Wenn Ihre Bewerbung nicht erfolgreich war, werden diese Daten sechs Monate nach Ablauf des Bewerbungsverfahrens gelöscht (Rechtsgrundlage Art. 12 Abs. 1 Nr. 2 BayDSG).

Wenn Sie bei uns immatrikuliert sind, speichern wir Ihre persönlichen Daten für die Dauer Ihres Studiums nach den gesetzlichen Vorgaben:

  • Anträge und sonstiger Schriftverkehr wird für die Dauer des Studiums und für sechs Monate darüber hinaus gespeichert, um den Studienverlauf nachvollziehen und ggfs. entsprechende Bescheinigungen etc. ausstellen zu können.
  • Prüfungsunterlagen sind nach § 12 der Rahmenprüfungsordnung für die Fachhochschulen in Bayern (RaPO) für zwei Jahre aufzubewahren, beginnend mit dem Ablauf des Kalenderjahres, in dem Ihnen das Ergebnis der jeweiligen Modulprüfung mitgeteilt wurde. Prüfungsunterlagen, die Gegenstand eines Widerspruchs- oder Klageverfahrens sind, werden davon abweichend bis zum rechtskräftigen Abschluss des Verfahrens gespeichert.
  • Eine reduzierte Prüfungsakte wird für die Dauer von 50 Jahren gespeichert mit Informationen über die Immatrikulationsdauer, die Prüfungsergebnisse, die Exmatrikulation und die Verleihung des akademischen Grades. Die Aufbewahrungsfrist beginnt mit dem Ablauf des Kalenderjahres, in dem Sie exmatrikuliert werden.
  • Persönliche Daten, die Finanztransaktionen betreffen (Studentenwerksbeiträge, Studiengebühren in den berufsbegleitenden Bachelor- und Masterstudiengängen) werden auf der Grundlage des Haushalt- und Steuerrechts für die Dauer von zehn Jahren gespeichert.

Ihre Rechte:

Ihr Recht auf Auskunft, auf Berichtigung von Daten bzw. Einschränkung der Verarbeitung, auf Löschung und Datenübertragbarkeit (Art. 13 Abs. 3 lit b, 15 bis 20 DSGVO)

Sie haben gem. Art. 15 DSGVO das Recht Auskunft darüber zu verlangen, ob und welche persönlichen Daten von Ihnen gespeichert sind, zu welchem Zweck sie genutzt werden, an wen die Daten übermittelt wurden, ggfs. woher die gespeicherten Daten stammen, sofern Sie nicht bei Ihnen persönlich erhoben wurden (Art. 15 DSGVO). Sollten Sie der Meinung sein, es werden unrichtige persönliche Daten über Sie gespeichert, haben Sie ein Recht auf Berichtigung dieser Daten gem. Art. 16 DSGVO bzw. gem. Art. 18 DSGVO auf Einschränkung der Verarbeitung bis zu Klärung der Richtigkeit. In Bezug auf personenbezogene Daten, die für den erhobenen Zweck nicht mehr benötigt werden, haben Sie ggfs. ein Recht auf Löschung von Daten gem. Art. 17 DSGVO.

Art. 20 DSGVO begründet Ihr Recht, die von Ihnen bereitgestellten Daten in einem strukturierten, gängigen, maschinenlesbaren Format zur Verfügung gestellt zu bekommen bzw. einem anderen von Ihnen benannten Verantwortlichen direkt zur Verfügung gestellt zu bekommen.

Ihr Beschwerderecht (Art. 13 Abs. 2 lit d, Art. 77 DSGVO)

Sollten Sie als Betroffene oder Betroffener der Ansicht sein, dass die Verarbeitung der Sie betreffenden personenbezogenen Daten gegen die DSGVO verstößt, haben Sie gem. Purpose and legal basis of the data processing (Art. 13 para. 1 lit c DSGVO)

We use the personal data collected to process your application for a place of study in accordance with the legal requirements and to prepare your matriculation in the event of a successful application for a place of study. If you enrol at the Deggendorf Institute of Technology (DIT), your personal data will subsequently be used for student and examination administration, to support the processing of your international affairs such as semesters abroad, for study organisation, scholarship matters and as a basis for talent promotion. In addition, we use the data for the anonymous tracking of study courses.

If you wish to remain in contact with us as alumni after your studies, a separate declaration / registration is required: Only then will we use the data for tailor-made alumni offers to you.

We also use the collected data to organise system access (network, online portals, learning platforms, library use, room usage).

In the application process we use your personal data exclusively for the contact with you and the handling of the application process; this also includes invitations to relevant information events.

In the student and examination administration, the data is used for contact with you, for application management (leave of absence, deadlines, credits etc.) as well as for internship, fee and examination administration within the framework of legal requirements. In the field of study organisation, we use the data for subject enrolment, timetable planning, etc. In the context of scholarship matters, we record your scholarship applications (e.g. German scholarships) to be processed via the university and use the available data for targeted information on scholarship programmes, talent promotion and the awarding of prizes to students and graduates. In some external scholarship programmes, the universities have the right to propose suitable students: In PRIMUSS, we identify the students who best meet the criteria of the scholarship programmes; a proposal in which your personal data is transferred to external scholarship providers is only made with your consent.

With your personal data we also support your application for places at foreign partner universities: Such an application is recorded and processed in the Mobility-Online-System of DIT. Current arithmetical examination grades are provided from PRIMUSS for the awarding of rankings, provided that there are more applications than places available. In the case of first-semester applicants, the average grade of the higher education entrance qualification will be transmitted due to a lack of examination grades.

As an applicant and if you are registered with us, you will receive password-protected system access from us for the digital processing of your application and your applications and procedures in the PRIMUSS portals for applicants and students: We log your accesses and activities in order to be able to trace the legality of the accesses and to prove the activities at any time. Beyond that no use of the protocol data takes place.

The legal basis for data collection is Art. 6 para. 1 lit c in conjunction with Art. 3 lit b DSGVO. Paragraph 3 lit. b DSGVO, Art. 42 Bavarian Higher Education Act (BayHSchG), the Bavarian Higher Education Admission Act (BayHZG) and the enrolment, re-registration and de-registration statutes of the Deggendorf Institute of Technology of 01 October 2013, as well as the Higher Education Statistics Act (HStatG).

Recipients or categories of recipients of personal data (Art. 13 para. 1 lit e DSGVO)

DIT will only pass on your data on the basis of legal authorisations or with your consent: No other data will be passed on.

In the case of study programmes that participate in the nationwide admission comparison, the so-called dialogue-oriented service procedure (DoSV), your application data will be transmitted to the Foundation for Admission to Universities responsible for the DoSV (see www.hochschulstart.de) for the nationwide application and admission comparison and will be compared with the data stored there (legal basis § 37 a Bayerische Hochschulzulassungsverordnung - BayHZV).

As part of the admission process and the course of study, your data will be compared with your health insurance fund (legal basis: Student Health Insurance Reporting Ordinance, SKV-MV of 27 March 1996 in its current version) and, if necessary, data will be transferred to the Studentenwerk Niederbayern/Oberpfalz in connection with BAföG applications submitted by you there (legal basis: §§ 47 / 48 Bundesausbildungsförderungsgesetz - BAföG).

In study programmes that we offer jointly with other universities or jointly award degrees, we transmit your personal data relevant to the degree to the partner universities. In the same way, these universities are obliged to comply with data protection regulations.

In study courses financed by fees, we partly work together with service providers who take on various tasks for us in the organisation and handling of the study courses. For this purpose, DIT will provide these service providers with the personal data collected from you and necessary for the service. It goes without saying that the service providers are obliged to observe data protection to the same extent as DIT.

In many scholarship programmes, the university has the right to propose possible candidates among the students: Your contact and performance data will only be passed on with your consent. A data transfer even without your knowledge is permitted on the basis of § 27 BayDSG for the preparation and execution of state or municipal awards or honours.

DIT operates PRIMUSS as examination, matriculation and student administration software in conjunction with nine other universities. The systems, including the online portals, are centrally hosted in the Regional Computer Centre Erlangen-Nuremberg and administered by the PRIMUSS network. The competence centre of the PRIMUSS network is responsible for the administration: The PRIMUSS competence team of Coburg University of Applied Sciences is responsible for the central administration and second-level support of the online services, while that of Deggendorf Institute of Technology is responsible for second-level support of the specialist applications. Your obligation to provide personal data / possible consequences of not providing such data (Art. 13 para. 2 lit e DSGVO)

Pursuant to Art. 42 Para. 4 Bavarian Higher Education Act (BayHSchG), you are obliged to provide all personal data relevant to the processing of your application and your studies. If you do not provide requested, decision-relevant data, you may lose claims based on these data (e.g. admission to studies, matriculation, examination, leave of absence, extensions of deadlines and access, etc.).

Planned storage period of your personal data (Art. 13 para. 2 lit. DSGVO) The following deletion and anonymisation periods apply subject to the implementation of the Bavarian Archives Act (BayArchivG). If documents are worth archiving, they will be offered for archiving before deletion or anonymisation and, if necessary, handed over.

Your applicant data will only be used to process your application. If your application was not successful, this data will be deleted six months after the end of the application procedure (legal basis Art. 12 Para. 1 No. 2 BayDSG).

If you are matriculated with us, we will store your personal data for the duration of your studies in accordance with the legal requirements:

  • Applications and other correspondence will be stored for the duration of your studies and for six months beyond, in order to be able to trace the course of studies and, if necessary, issue appropriate certificates, etc.
  • According to § 12 of the Rahmenprüfungsordnung für die Fachhochschulen in Bayern (RaPO), examination documents must be kept for two years, beginning with the end of the calendar year in which you were informed of the result of the respective module examination. Examination documents that are the subject of an objection or complaint procedure will be stored until the procedure has been legally concluded.
  • A reduced examination file is stored for a period of 50 years with information on the duration of matriculation, examination results, exmatriculation and the award of the academic degree. The retention period begins at the end of the calendar year in which you are exmatriculated.
  • Personal data relating to financial transactions (student union fees, tuition fees for part-time Bachelor’s and Master’s programmes) are stored for a period of ten years on the basis of budgetary and tax law.

Your rights:

Your right of access, rectification or limitation of processing, deletion or transfer (art. 13 par. 3 lit b, 15 to 20 DSGVO)

Pursuant to Art. 15 DSGVO, you have the right to request information on whether and which personal data of yours are stored, for what purpose they are used, to whom the data have been transmitted, if applicable where the stored data originate, unless they have been collected from you personally (Art. 15 DSGVO). If you are of the opinion that incorrect personal data concerning you are stored, you have a right to correction of this data pursuant to Art. 16 DSGVO or pursuant to Art. 18 DSGVO to restriction of processing until clarification of accuracy. With regard to personal data that are no longer required for the purpose for which they were collected, you may have a right to deletion of data in accordance with Art. 17 DSGVO.

Art. 20 DSGVO establishes your right to have the data provided by you made available in a structured, common, machine-readable format or to have it made available directly to another responsible person appointed by you.

If you as a data subject are of the opinion that the processing of your personal data violates the DSGVO, you also have the right to lodge a complaint with a supervisory authority pursuant to Art. 77 DSGVO without prejudice to any other administrative or judicial remedy. Your right to object from a special situation ("atypical constellation") - (Article 21 DSGVO)
